Summary
Caves are country's assets, according to art. 20, X, of the Brazilian constitution, and cultural and environmental heritage of Minas Gerais, according to art. 208, V, and art. 214, § 7 of the constitution of Minas Gerais. CONAMA Resolution No. 347, of 2004, and Federal Decrees No. 99,556, of 1990, No. 6,640, of 2008, and No. 10,935, of 2022, which replaced the previous two, determine that there must be environmental licensing when there is potential for impacts on speleological heritage. Environmental licensing and the assessment of environmental impacts are effective instruments of the National Environmental Policy, Federal Law No. 6,938, of 1981. It can be seen, however, that, with regard to speleological heritage, such instruments have attested functionality, notably, when prepared in a preventive manner, that is, before interventions in nature or the exploitation of natural resources, and consequently before the incidence of impacts on caves. In cases where damage to speleological heritage occurs, without authorization from the environmental licensing process, there is federal regulatory gap that establishes forms of reparation and compensation. Filling this gap, in the state of Minas Gerais, State Decree No. 47,041, of 2016, establishes criteria for compensation and indemnity as a result of damage caused to caves in the territory of Minas Gerais. This decree provides that the procedure will take place through the signing of a Conduct Adjustment Term (TAC) between the person who caused the damage and the environmental agency. It is concluded that this state regulation makes it possible to avoid legal action by objectively establishing the calculation of compensation for damage to speleological heritage and by determining appropriate compensatory measures. Cavernas são bens da União, conforme art. 20, X, da constituição brasileira, e patrimônio cultural e ambiental de Minas Gerais, segundo art. 208, V, e art. 214, § 7º da Constituição Mineira. Segundo a Resolução CONAMA nº 347/2004, e os Decretos Federais n° 99.556/1990, n° 6.640/2008, e n° 10.935/2022 há necessidade de licenciamento pelo órgão ambiental competente quando houver potencial de impactos sobre o patrimônio espeleológico. O licenciamento e a avaliação de impactos são eficazes instrumentos da Política Nacional do Meio Ambiente, Lei Federal nº 6.938/1981. Verifica-se, contudo, que, no que tange ao patrimônio espeleológico, tais instrumentos têm funcionalidade atestada, notadamente, quando elaborados preventivamente, ou seja, antes das intervenções na natureza ou exploração de recursos, logo anterior à incidência de impactos às cavidades. Para casos de danos ao patrimônio espeleológico não autorizados pelo licenciamento ambiental, observa-se haver lacuna legal, sem que haja determinação em normativa federal que estabeleça formas de reparação e compensação. Nestes termos, em Minas Gerais o Decreto Estadual nº 47.041/2016 dispõe sobre os critérios para compensação e indenização pecuniária em decorrência de danos causados em cavernas existentes no território do Estado. Verifica-se que este decreto prevê que o procedimento se dará mediante celebração de Termo de Ajustamento de Conduta (TAC). Conclui-se que esta normativa estadual permite evitar judicializações ao estabelecer de forma objetiva o cálculo de indenização de danos ao patrimônio espeleológico e ao determinar medidas compensatórias devidas.
